Delta Airlines Faces Lawsuit for Racial Discrimination Aboard Flight 5792

In a troubling incident aboard Delta Flight 5792, Teresa Hudson Jordan and her 15-year-old daughter were removed from their flight after what they allege was racial discrimination. Joseph & Norinsberg are representing the family seeking justice through legal action.

Incident on Delta Flight 5792

In March, Teresa Hudson Jordan and her daughter were sitting in first class on a routine flight from Lexington, Kentucky to New York City when they were unexpectedly removed from Delta Flight 5792. What began as a normal interaction soon escalated into a disturbing ordeal. The incident began when Jordan had turned to speak with her daughter, and in the process inadvertently made eye contact with a flight attendant during the boarding process. The attendant, identified only as “Stephanie,” reportedly confronted Jordan (who at this time had not said a word but just inadvertently made eye contact with Stephanie), yelling, “Don’t look at me like that. Don’t eye me up and down. If you can’t comply with my demands then I’ll turn this plane around and we can go back to the gate.” This aggressive response by the flight attendant left Ms. Jordan shocked. Ms. Jordan then confirmed compliance with the demand of the flight attendant but that was not enough as Stephanie continued yelling at Ms. Jordan. Again Ms. Jordan tried to reiterate her compliance with the directions being shouted towards her, even doing so multiple times in a manner that ensured those around her could hear she was trying to comply. After the unsettling Ms. Jordan, thinking the situation had passed, was ready to just move on as she had an important medical appointment for her daughter in New York that they were flying to. Unfortunately, the situation was not passed as Stephanie took it upon herself to go back to the captain of the flight and report that in some way Ms. Jordan had been disruptive and refused to comply with her demands. This then led to Ms. Jordan and her daughter being removed from the flight.

This was so troublesome for Ms. Jordan that months later, five months later, it was still bothering her and her daughter, who’s literally been undergoing therapy since the incident.

The Legal Claims Against Delta Airlines

The lawsuit filed by Joseph & Norinsberg includes several key allegations:

  1. Racial Discrimination – The Jordans claim the flight attendant’s behavior was racially motivated, as Jordan did not engage in any disrespectful behavior. She simply responded, “I comply,” to the attendant’s remarks.
  2. Intentional Infliction of Emotional Distress – The family experienced significant emotional harm from the ordeal, which included public humiliation.
  3. Assault – The forced removal from the flight, in front

We are going to hold these people’s feet to the fire, and we’re going to make sure that at the end of the day, they are held accountable.

How Eyewitness Support Strengthens the Case

The Jordan family’s account is bolstered by the testimony of four independent passengers who witnessed the altercation. Their statements directly contradict the flight attendant’s version of events that led to the Jordan’s being removed from the flight, with one passenger even comparing the treatment of Ms. Jordan to being “treated like a dog or a slave.”
