5 star review logo

We are proud of our five-star Google rating, not because of the number but because of the satisfied clients it represents. We treat all our clients like family, and many stay in touch with us long after their cases are resolved. We regularly receive unsolicited client testimonials such as the following:

When other firms give up, we keep fighting because we know employment cases take preparation and determination to resolve. We have an extensive record of success in these complex cases.

Here are a few examples of the results we have achieved for wrongfully terminated clients:

  • We won a $1,040,000 settlement for our client against a school for failure to accommodate and wrongful termination.
  • We obtained a $1,000,000 settlement with a hospital for failure to accommodate and wrongful termination.
  • We secured a $600,000 settlement with an international investment firm over age discrimination and wrongful termination.

What Is Wrongful Termination in New Jersey?

New Jersey is an “at-will” employment state, meaning employers can terminate employees at any time for any reason or no reason. They just cannot fire someone for an illegal reason. However, New Jersey has several important laws preventing employers from firing someone illegally, including the :

  • The New Jersey Law Against Discrimination: Employers cannot terminate employees for discriminatory reasons, including “perceived or actual race, religion, national origin, gender, sexual orientation, gender identity or expression, disability, and other protected characteristics.”
  • The New Jersey Conscientious Employment Act: It is illegal for employers to take any retaliatory action against a whistleblower employee.

New Jersey also does not permit an employer to terminate an employee if a contractual provision prevents termination.

Examples of wrongful termination in New Jersey include firings involving the following:

  • Discrimination: It is illegal to fire someone due to their protected class status, including race, religion, national origin, disability, age over 40, pregnancy, or sexual orientation.
  • Retaliation: New Jersey law prohibits terminating someone for exercising their workplace rights, including filing a discrimination complaint, requesting family and medical leave, reporting illegal activity, and organizing collective bargaining.
  • Breach of contract: Employers cannot violate provisions of employment contracts, such as terms preventing firings without proper cause.
  • Whistleblowing: Employers cannot punish employees for reporting violations of law or public policy.
  • Violation of a law: Many laws prohibit firing employees for certain explicit reasons, such as serving on a jury or voting.

Wrongful termination cases are changing as new technology replaces old social norms for sharing information. For instance, in a recent example, a woman was terminated when she posted about her salary on her TikTok account, and her employer fired her for “safety concerns.” The woman did not choose to sue her former employer.

However, our founding partner, Bennitta Joseph, told USA Today the following:

[The woman] could have a good case if she considers taking legal action … she should think about contacting a lawyer if she can show she was terminated for discussing her wages.

Bennitta noted that most employees are fired for performance or disciplinary reasons, and employers are not shy about monitoring their employees’ social media accounts. “The higher up you are, the more careful you have to be about what you post,” she said.

Potential Remedies and Compensation Available for Wrongful Termination Claims in NJ

Whether your remedy comes through a settlement or a judgment, there are several potential remedies available in wrongful termination cases in New Jersey:

  • Reinstatement: Getting your job back is rare but can happen through litigation or settlement negotiations.
  • Lost wages: You can seek compensation for past and future lost income from being fired.
  • Emotional distress damages: You can pursue Monetary compensation for mental anguish related to the wrongful firing.
  • Attorney’s fees: In employment cases, plaintiffs can recover reasonable attorney’s fees if they prevail.
